The Pension Protection Act of 2006 now gives any person 70 1/2 or older who has significant assets invested in Individual Retirement Accounts (IRAs) the ability to make a gift from an IRA during tax years 2008 and 2009 without the fear of being penalized.

The law allows a transfer of up to $100,000 directly from an IRA to a qualifying charity without having to consider the amount as income. The amount transferred for the donation is not taxable - unlike previous years.
